2017 Sweepstakes Official Rules
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. PRODUCT PURCHASE DOES NOT ENHANCE YOUR CHANCES OF WINNING. ALL FEDERAL, PROVINCIAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
1. Sweepstakes Period
The “ivivva for PBteen” 2017 Sweepstakes (the “Sweepstakes”) begins at 9:00 AM Pacific Time (“PT”) on July 21, 2017 and ends at 1:00 PM PT on August 11, 2017 (the “Sweepstakes Period”).
2. Eligibility
The Sweepstakes is open only to legal residents of the fifty (50) United States, the District of Columbia, and Canada (excluding Quebec) who are at least eighteen (18) years of age at the time of entry, or the age of majority in their state/ province of residence, whichever is greater, and who are the parent or legal guardian of a child between the ages of five (5) and seventeen (17) at the time of entry (the “Designated Child”). Residents of Quebec are not permitted to enter the Sweepstakes. Employees of ivivva athletica canada inc. (“Sponsor”), ivivva usa inc., Pottery Barn, PBteen, and their respective parent companies, affiliates, subsidiaries, divisions, advertising, and promotion agencies (“Sponsor Entities”) and their immediate family members (parents, children, siblings, spouses) and those living in the same household of each, are not eligible to participate in this Sweepstakes. All federal, provincial, state and local laws and regulations apply. Void where prohibited by law.
3. How to Enter
To enter the Sweepstakes you must go to http://www.ivivva.com/products/category/pbteencontest and complete and submit an online form with certain information including your name, birthdate, e-mail address, Country, State or Province during the Sweepstakes Period (each an “Entry”). Only one (1) Entry per person and per e-mail address. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected Entries, which will be disqualified. All Entries must be received by Sponsor by 1:00 PM PT August 11, 2017. Proof of sending will not be deemed to be proof of receipt by Sponsor. Entrants who have successfully submitted an Entry may receive additional entries (each a “Bonus Entry” and also an “Entry”) in the following ways:

Any other attempted forms of entry are void and will not be accepted. Sponsor will not acknowledge entries or correspond with entrants. Entrant must be the registered and authorized account holder of the e-mail account through which the Entry is made. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an internet service provider, or other organization (e.g., business, educational institution) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. In the event of a dispute as to ownership of an Entry, entrant may be required to provide proof of ownership of the e-mail account used to enter the Sweepstakes. Entries may not be made by
proxy or automated means such as by script, bot, macro or any other similar software or program.
By entering this Sweepstakes, entrants give their express permission to be contacted by Sponsor Entities via telephone, e-mail, and/or postal mail concerning this Sweepstakes.
4. Winner Selection and Notification
The Sweepstakes consists of three (3) weekly drawings and one (1) Grand Prize drawing. Within or about one (1) day after the close of each week of the Sweepstakes Period as described below (the “Weekly Periods”), five (5) winners will be selected in a random drawing from all eligible Entries received prior to the close of the Weekly Period (including Entries received during prior Weekly Periods), for a total of fifteen (15) weekly winners (the “Weekly Winners”). Only one (1) Weekly Winner prize per person.
Weekly Periods:
• Week 1: July 21, 2017- July 27, 2017
• Week 2: July 28, 2017- August 3, 2017
• Week 3: August 4, 2017- August 11, 2017
Grand Prize Drawing:
On or about August 12, 2017 one (1) Entry will be selected in a random drawing from among all eligible Entries received during the Sweepstakes Period to be the potential “Grand Prize Winner”. All eligible entrants, including Weekly Winners, are eligible to be the Grand Prize Winner.
Entrants who have been selected to potentially receive a prize will be notified by e-mail at the e- mail address provided in the Entry. In order for a selected entrant to be declared a Weekly Winner or the Grand Prize Winner and be eligible for a prize, the selected entrant must: (a) have complied with, and remain in compliance with, these rules, (b) sign and deliver to the Sponsor, within five (5) days after the Sponsor’s request, a standard declaration and release form, which may include an affidavit of the entrant’s compliance with these rules, an acceptance of the prize as awarded, and except where prohibited, a publicity release and a liability release, and (c) if the entrant is located in or resides in Canada, correctly answer a skill-testing question. Potential winner may be required to provide proof of identity, residency, age and other documentation. If potential winner fails to comply with all requirements in this paragraph, prize will be forfeited and may be awarded to an alternate winner.
The decisions of Sponsor are final and binding on all matters relating to this Sweepstakes. If within three (3) days of first attempted notification any potential winner cannot be contacted at the e-mail address submitted with the Entry for any reason, if a potential winner is contacted and does not respond as directed, refuses the prize, does not comply with the above conditions, or is ineligible to accept the prize, or if prize is returned as undeliverable, the prize will be forfeited and an alternate potential winner may be selected from amongst all remaining eligible entries received during the applicable Weekly Period for Weekly Winners or during the Sweepstakes Period for the Grand Prize Winner.
Odds of winning a prize depend on the number of eligible Entries received.
5. Prizes
• Fifteen (15) Weekly Winners will each receive one (1) one hundred ($100) gift card to ivivva and one (1) one hundred dollar ($100) gift card to Pottery Barn Teen.
• One (1) Grand Prize Winner will receive the following (the “Grand Prize”)
o One (1) two thousand five hundred dollar ($2500) gift card to PBteen;
o One (1) one thousand dollar ($1000) gift card to ivivva;
o One (1) one thousand dollar ($1000) gift card to lululemon; and
o One (1) one thousand dollar ($1000) gift card to Pottery Barn.
The Approximate Retail Value (“ARV”) of the Grand Prize is five thousand five hundred United States Dollars ($5,500 USD) for U.S. residents and five thousand five hundred Canadian Dollars (CDN$5500) for Canadian residents.
U.S. residents will receive all gift cards in U.S. Dollars, Canadian residents will receive all gift cards in Canadian Dollars.
No substitution, transfer or assignment of a prize is permitted, except Sponsor may substitute another prize of approximately equal or greater value if the advertised prize or any portion of the Prize is unavailable for any reason. Gift card prizes subject to standard gift card terms and conditions. Winners are solely responsible for any applicable and unspecified expenses in conjunction with acceptance/use of the prize, including federal, provincial, state and local taxes.
All federal, state/provincial and/or local income and other taxes, if any, are the winner’s sole responsibility. Winners residing in the United States may be issued a 1099 tax form for the ARV of the prize.
The prizes are awarded “AS IS.” Sponsor does not make or offer any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with this Sweepstakes or the prizes.
6. Permission to Use Name and Likeness
Except where prohibited by law, participation in Sweepstakes constitutes permission from entrant for the Sponsor Entities to use entrant’s and Designated Child’s name (first and last), likeness, and/or other indicia of persona, without notice or compensation for purposes of advertising and trade, unless prohibited by law. Further, participation includes the right to post Weekly Winners’, Grand Prize Winner’s and Designated Child’s first name, last initial and city and state or province of residence on Sponsor Entities’ websites and social media pages, except where prohibited by law.
7. Privacy
All information submitted in connection with this Sweepstakes will be treated in accordance with these Official Rules and Sponsor’s Privacy Policy available at http://info.ivivva.com/privacy?mnid=ftr;privacy. By participating in this Sweepstakes, each entrant agrees to that privacy policy.
8. Winners list/ Official Rules
The Official Rules (available during the Sweepstakes Period) and Winners List (available after winners are confirmed) may be requested by sending an e-mail to hello@ivivva.com. Requests received more than three (3) months after the Sweepstakes Period will not be acknowledged.
9. General Rules
By entering the Sweepstakes, entrants accept and agree to be bound by these Official Rules. Any violation of these rules may result in disqualification. All decisions of the Sponsor regarding this Sweepstakes are final and binding in all respects. Sponsor’s or its agent’s computer will be the official clock for the Sweepstakes. Sponsor Entities are not responsible for technical, hardware, software or telecommunications malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the sender, or by any of the equipment or programming associated with or utilized in this Sweepstakes which may limit the ability to participate (including but not limited to defects/errors/malfunctions), or by any error which may occur in the entry process or the Sweepstakes. Without limiting the foregoing, Sponsor Entities are not responsible for electronic communications/e-mails not received due to e-mail filtering, virus protection, or other protective devices/apparatus or any other cause.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATIONOFCRIMINALANDCIVILLAW. SHOULDSUCHANATTEMPTBEMADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW (AND TO DISQUALIFY SUCH FROM THE SWEEPSTAKES IF APPLICABLE). If for any reason something (including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Sponsor) corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes and renders the Sweepstakes incapable of being conducted as described in these Official Rules, Sponsor shall have the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes in whole or in part. In such event, Sponsor shall make the prizes available in a manner, determined by Sponsor in its sole discretion, to be fair, appropriate and consistent with the spirit of these Official Rules. Notice of such action by Sponsor will be posted on the ivivva Sweepstakes page at http://www.ivivva.com/products/category/pbteencontest
All claims arising out of this Sweepstakes and all issues and questions concerning the construction, validity, interpretation, and enforceability of the Rules, or the rights of entrants, shall be governed by and construed in accordance with the laws of British Columbia and the laws of Canada applicable in British Columbia, without regard to conflicts of law principles.
10. Waiver and Release
To the maximum extent permitted by law, by entering the Sweepstakes entrants agree to release and hold harmless the Sponsor Entities from and against any and all claims, causes of action, losses, damages, liabilities, deficiencies, actions, judgments, interest, awards, penalties, fines, costs, or expenses of whatever kind (including reasonable attorneys’ fees) for any injuries, losses, damages, costs, or expenses of any kind to person(s), including without limitation, personal injury and/or death, or property damage resulting in whole or in part, directly or indirectly, from entrants’ participation in the Sweepstakes, or acceptance, possession, misuse, or use of a prize, participation in any prize- related activities or any other services or activities offered and/or provided by Sponsor in association with this Sweepstakes, any and all tax liability that may be imposed or associated with receipt or use of a prize, for claims based on publicity rights, defamation or invasion of privacy, and merchandise delivery, and for winner’s and (in the case of the Grand Prize Winner) Grand Prize Guests’ breach of any representation, warranty, or obligation under these Official Rules. Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the Sweepstakes or in the announcement of prizes.
